goods received in error

we ordered some items from mail order and as a thank you we were suppose to receive some chocolates. Instead of the chocolates as displayed on the advice note we received a very expensive electronic gadget. Please could someone tell me is this a human error in our favour or do we have to return.

The company are collecting tomorrow. The person who was awaiting the item has contacted saying all they have received is a box of chocolates (well the advisor was limited in what she told me due to data protection). Also a new box of truffles is on its way to us. A 40% discount on the order that I placed has been applied (i thought it was on future order), but...

why does it matter what it is. No matter what it is it comes under "goods received in error" Is it important regarding the question??

@sherrak I am no way a benefit scrounger, I work all the hours I can, keep a clean house, look after my disabled little boy and live an honest life. Why not ask for something for nothing for doing good!
It may be important if it is a smart phone or similar item, in which case it may become as useful as a chocolate teapot when the vendor blocks it believing it stolen.

You have no legal right to keep the item and no legal right to a reward for honesty. You do risk prosecution for theft if they report it as stolen.
ladybirder...I am just curious. It could be something like a 'wind-up' radio and they are not all that expensive.;-)

Okay cheapnchic- we have no right to know what the item was, but this is a sort of community where people like to chat as well as help each other, and where people are interested I think it helps build relationships to answer their queries.
I didn't say you were a benefit scrounger. How is it asking for something for nothing for doing good? What good are you doing? You just want to keep something that is not yours for yourself and you are looking for people to validate your decision so that you don't feel bad about it. It's hardly 'living an honest life' IMO.
I don't think it matters exactly what it is cheapnchic, but it would be nice to know, just out of interest, what we are talking about.

As we said, there's no harm in asking, and they may offer something, but if they say they will simply collect it you have no case in law for a reward

@sharrack again, have I said I am keeping it, have I said i am not going to return it, think you will find the answer if NO!!. And for your information have finally got through to the company. They are giving me 40% off my next shop for the inconvenience caused to me, and are collecing the IPAD2 tomorrow via courier. The question is now what do I spend my 40% discount on.

So you have contacted the company and got it all sorted, well done. Not sure why you bothered asking the question in the first place. At least you can spend your discount with a clear conscience.
If they contact you , tell them you have the article, do not go to any trouble trying to post it, tell them they can collect it if they wish to do so. If you have not heard from them within three months do as you wish with the item.

sherrack, if you look back it was so i knew my rights. As I was contacting them. If I am being honest and returning something that I am not legally obliged to do so then why should I not be rewarded with a gratitued. The company were very shocked by the way and have no idea how it has happened.
I was under the impression that you were legally obliged to inform them that you had received the goods in error and to allow the company the opportunity to collect them or to have them returned. Isn't honesty it's own reward?

Can't see if you've had the correct answer or not, so, legally you are under no obligation to return at your expense but you must make it available for collection you must also make sure you let the company know you have it and that you have received it in error
