if you tone up, and replace fat with muscle you could conciebable lose size but not weight
Yes - go to a different shop.

Women's dress sizing is one of the most ridiculous exercises in vanity known. Some shops sell dresses that are clearly larger, but label the as "Size 8", thus encouraging their hapless customers to buy them so that they can proudly announce "I'm only a size 8, you know".

Dress sizing should be on the basis of objective measurement in same way that most other clothes are provided.
muscle weighs more than fat, so conceivable that you could put on weight, yet slim down
In some factories, the dress size also depends on how many labels they have left. If someone is finishing size 14 dresses, they have a stack of size 10 labels, and it would eat into their wage if they went for more labels, what would you do?
