If a male and a woman are having sex and the woman is too drunk to know what's going on should this be classed as rape?

Difficult subject to have an opinion on.
If true, it is utterly alarming !
Why on earth does it seem that the message failing to get through to young men ?
"NO" means just that and if person says this it means "NO".

However waking up in bed the next morning with a strange guy and a hangover does not automatically mean that you have been raped.
Sex without consent is rape....if the man bought her drinkswith a view to rendering her incapable of refusing then probably yes no difference if it is alcohol or any other date rape drug but if she was drunk anyway she might have a harder time proving she didn't consent... especially if she was seen to behave in a way that implied she was willing,,,not sure about the morals of any man that took advantage in this way though
Technically, it is rape ... of course.

If a girl is drunk, she can't give consent.

If she hasn't given consent, it is rape.

If a guy is sincere about a girl being a willing partner, he should make sure before she gets drunk that she is happy to sleep with him.

Then, it becomes a matter of evidence ... how to prove she was willing, before she got drunk.

Guys can't assume that any girl who gets trolleyed is an easy shag.
If you outlaw any sexual encounter that begins with a man getting a woman a drink, you're not going to have many left.
JJ, I dunno... most people don't 'give consent', drunk or sober. They may say No, but how many (of either sex) say Yes? It usually has to be inferred from their actions, not their words... which is where the problem arises.
The trouble lay in the fact that she may well have given her consent, when drunk, but just cannot remember doing so the next morning, when sober.
Inferred from their actions ... yes, like taking your clothes off and kissing his bits.

As opposed to ... falling on the bed, motionless, with a glazed look in your eyes.

If a girl is a regular partner, it is reasonable to assume she is a willing participant ... even when she's p!ssed.

I love a p!ssed shag ... it's psychedelic and jolly.

But if a guy is just getting to know a girl, and she gets p!ssed, he should get her home, get her to bed with a towel, and phone her the next morning.
Difficult subject but I think you generally know and SHOULD know for sure if it's a two way street or not and if the girl/boy is responding to the lovemaking going on........if not, then yes, it could be concieved as not consentual...and therefore rape. No excuse for it.

There is something quite jolly about a guy doing it to you when you're so trolleyed you're not sure if it's a dream.

1. You agree it's okay beforehand, and

2. You let him know if you're going to throw up.

Actually, it applies both ways.

If he's drunk, he can't consent to her making love to him.

But guys who are really drunk do tend to have one little physical complication (if you know what I mean) which makes if less likely that she can do it to him.
Less likely, yes....OH doesn't suffer from that problem though. So I presume there are other men out there like him...
