In the news today a Woman went to the cash point to find �135,000 in her bank account that wasent hers.
She blew most of it in weeks.
Would you do the same?
I would, I think if its their mistake then its tough.

Instead of blowing it all on holidays and plasma screens, I would transfer the lot over to another bank then if they asked for it back then you could have a few quid interest from their mistake before giving it back.

I dont think the lady should be in court over this. Its all wrong.

yes she needs to pay it back but she is only 20 and a single mum give her a break! what happens to her child if she goes in prison this is no good for her or the child. much worse cases do not go to prison but get let off with stupid fines or very short sentances. she just enjoyed having some money for once even though it was wrong
No - being a single mother is no excuse for her larceny: there are countless other single mothers out there who don't resort to stealing.

And as for paying back a tenner a week - what a ridiculous idea....if my maths are correct, it would take her 250 years to pay it back. Stupid idea. If you suggested a figure of �10 as a notional figure, where is the punishment? Make it �100 a week. Can't afford it? Off to prison you go.

If I were the recipient of the �135k, (thinking I could keep it!!) I would have spent the money on life improvements ie, my home, car etc instead of just blowing it all on nothing. This shows that she is obviously either thick or she knew what she was doing, in illegally cashing in the money. She is just a stuipd cow who thought she'd got lucky!!

About 15 years ago, they used to practice transferring money into real accounts. Once in a while they would mess it up and put a variety of amounts into peoples accounts for real. The banks just used to chalk it up to a mistake and leave the money there unless the account holder came clean and said hey there is too much money in my account. I don't think they were able to take the money back out. I think this 135,000 must have been someone else's money.

I would have gone and asked for advice on whether I should spend it, or move it out of the account etc... and then probably realised I couldnt get away with it, Id spend a grand or summit though and then come clean.

I dont think she will go to prison.

P.S. As I said earlier, this woman is in no doubt guilty of theft, however:

Regarding my comments that this woman should be made to repay the money at a tenner a week. This amount was slightly tongue in cheek of course, but it would serve the bank right for making the error in the first place & they do make quite a few of them!

Regarding her not going to prison - of course she should go to court, but made to do many, many hours Community Service. I think that would serve more purpose than throwing her into a cell, costing the tax payer thousands & her daughter being without her Mummy.
What an odd debate. Everyone seems to have switched. The hang-'em-high briagde are saying she should walk and some of the lefty liberals want her to do time.

Maybe it's because this looks more like one of those safe, middle-class thefts.

I don't think NJOK's answer is too odd Smudge, I was thinking much the same thing myself actually. (Tho I have been called odd in my time!)

I think Grommit was being a bit tongue in cheek with his answer but actually making the same point as NJOK too.

My own two pennies worth are that to send her to prison would be to punish her for being an idiot. I agree with Smudge that she should be made to pay the money back at a reasonable rate on a weekly basis. This way the bank has to give the �135,000 to its rightful owner but will eventually get the money back (after a very long time). It'd be a way of dealing with the stupidity of both the bank and the person.
CD - Well all I can say is that NJOK must scrutinise every AB'er to know what their thoughts are on here - you'd have to have a rather big head, sorry big brain, to log all that info!

I just wouldn't have the time to do that - not that I'd ever want to.

Anyway, whatever class he, or anyone else thinks I should be in - I still don't think this woman should go to prison.
As far as I'm aware, being an idiot is not a valid defence in the laws of the UK - although I am happy to be corrected on this point!

This woman knew exactly what she was doing.

She is a common thief.
Let's say she has to pay it back over 25 years, and let's say the bank won't charge her interest, that's �103.85 a week, which I presume is unaffordable.

Little old ladies get sent to prison for withholding their council tax - this woman has stolen �135,000.

She deserves prison.

But what good is a prison sentence going to do her or her kid?

Shouldn't the bank take some responsibility for c0cking up in the first place?

Surely paying back the money and returning all the junk she brought would be enough of a punishment.

It's not like she's going to be out on the steet mugging old ladies to feed her dildo habit if she doesn't go to prison is it. I just think a slightly more measured response is called for.

China, you're right. The bank should certainly take some of the blame.

But I think that would be reflected in the sentence - the fact that this was a crime of opportunism rather than a calculated act will mean that she'll get a lesser sentence

I think the Ferrari analogy is spot on though. She knew it wasn't hers but she still nicked it!

Incidentally, I once did the same. I withdrew �1100 in cash over the counter at HSBC. I got home and realised they'd given me �600 too much. In cash. Ker-ching!
What good is a prison sentence?

It. Is. A. Punishment.

She knowingly stole money that wasn't hers.

Where do we draw the line in the sand? What about people who commit unpremeditated murder - manslaugther. This is out of charachter and a one-off, and they probably won't go on to kill anybody else.

Should they be saved from a prison sentence because they have been an 'idiot' - even though the killed person was asking for it?

This woman deserves a prison sentence.

Really - it appeared a little more personal that! Why say everyone seems to have switched, etc., etc? Everyone has a right to their own opinions & what suits them at the time - if it doesn't suit you, then why don't you just move on.....?
