In my opinion. What do you think?
A young man enters an older man's dwelling to confront him. Batters him to death. Found not guilty on all counts by a jury.
There's more to it but you'll have to read the news report if interested. It's complicated and I'm afraid of having a wrong point of view.

You can't have a wrong point of view. You can get facts wrong but your opinion of the correct facts is as valid as a person with an opposing opinion
Question Author
Yeah, you'd think that, Barrie.
Question Author
Barry, sorry.
Only in America. Life is precious and this man murdered because of his feelings, he went way over the top and i hope the case can be retried.
If the accused is deemed not guilty, has the court established exactly how the deceased sustained his multiple injuries?
It's not 'only in America', William. Self-defence is a valid defence in the UK and most of the western world.
Yes Barry, but if i read it correctly the man entered the others house and killed him. Self defence?.
Self-defence because he believed the man was reaching for a gun.
Don't forget he was invited in the man's home, he didn't force his way in.
The camera evidence proved he was in the house for less than three minutes.
naomi, the dead man (A) had been punched in the face when he grabbed the other man's (B) genitals - a reflex action the court was told.
B then believed that A was reaching for a gun and stamped on A's face before fleeing.
It is a complicated case. It would have been interesting to be in that court room.
Thanks Barry.

Is the 3 minutes of any significance, Barry?
Also, Etute made no mention of Smith reaching for anything in his original statement.
Question Author
I also find it hard to believe anyone could do so much damage to a face with bare hands (and 1 kick/stamp). Pure speculation on my part of course. But only 2 people knew for sure what happened in that room and 1 of them isn't talking.
^that was my thought when I posted earlier.
Question Author
Also B (Etute) did the genital grabbing and the punching.
no he didn't, Spicerack

//Etute testified that Smith grabbed at Etute's genitals, causing Etute to strike Smith in the face with the back of his hand//
spicerack! havent seen you for aaaaaaaages
I don't know how I would react if I found out a woman I had sex with was really a man. In the UK it is a prisonable offence to pretend to be a different gender to get sex.

I think the three minutes is significant. It wasn't a sustained attack, it was proven to be one punch and one stamp and it was also proved that the man was still alive when the attacker left.

The whole thing is rather grubby and unpleasant. I can see how the jury would have sympathy for the defendant especially if the majority were men.

Would it affect our thoughts if we could see the defendant and pictures of the dead man?
