A couple of questions about The Smiths

I have a couple of questions to ask about the history of The Smiths if anyone can help me. 1) Is it true that they don't have any control over the rights to their back catalogue, and if so, why is that the case? 2) What was the origin of the conflict between Mike Joyce and the others? I read a quote from Morrissey and it seemed like Morrissey really hated Joyce. I have a vague memory of reading an article a long time ago about a court battle over royalties, can anyone give me more details? Thanks to anyone who can help me with these questions.

Not sure about their back catalogue, but the fall out was over royalties. Joyce and Andy Rourke felt entitled to an even share, whereas Morrissey and Marr claimed that the other two could have 'been replaced by session musicians'. Johnny Rogan's book 'The Severed Alliance' is worth a look to get the full story
The problems arose from the fact that in the early days, Andy Rourke and Mike Joyce never signed a contract. They thought they were getting 25% of royalties from records and live performances, but when the band split they realised they were only getting 10%. Johnny Marr insisted that they'd had a verbal agreement that they'd get 10%, whereas Mike Joyce had no recollection of any such discussion. Andy and Mike sued Johnny and Morrissey, but after 2 years, Andy decided to settle out of court, and Mike battled on alone, which is probably why there is a bit more animosity between Joyce and Morrissey. Also, I echo what jackb says about reading 'The Severed Alliance'. It's a great book.
