hi my name jacqueline i from glasgow i have been driving for 7 years have had clean licence always ,few month back i was going through hard time and i went south to visit a friend on my way i was done for speeding on m74 i was doing 108 miles an hour i have never been in trouble before i have never been to court before and i dont know what to expect ,my lawyer has said it is an instant bam is this always the case i have three kids whom depend on my car for their clubs etc....... will the courts take my personal details into consideration , any information you can give would be most appreciated thanks jackie xxxxxxxx

An obligitory disqualification is only applied when drink driving, unfit through drugs, causing death by either of these above or causing death by dangerous driving. They will take your circumstances into consideration, though you will have to lay it on thick- if poss give the reason (bereavement- divorce-whatever applies) not something that they can consider to be ongoing causing further risk. (you want them to believe it wont happen again). You need a more solid reason for your requirement to drive too- work out of public transport hours- need it as part of your job - regular hospital attendance ?. my brother did lose his licence for 17 days after being caught doing 105 MPH on the M6, he claimed he needed the car to keep his job and the employer was also a witness to varify this fact, it was the 17 day sentance that the employer was willing to give him to make it a "punishment" as well as not to deprive him of his livlyhood, in short they will listen to personal reasons, though from now on I would stick to the 70MPH speed limit on the motorway, Wish you the best of luck with your court case, hope all goes well for you
I think it is an instant ban. If you are going 31 or more m/p/h over the speed limit, i think it leads to an automatic ban. Not 100% sure though on this. Its just what I heard.
i know someone a few months ago that lost his licence for 30 days as he was caught doing 103 on the M25, he said he needed his car for work and that didnt change a thing. i think once your caught going over 100 then you need to start thinking you will get a ban, As you was doing 38mph over the limit as well
It will be an automatic ban. The court will probably view it that the safety of your three children is also vital. Driving at that speed was dangerous love.
Oh dear.....it just doesn`t help when you explain that you were unaware of your speed creeping up. 70 is the LIMIT even though at times it may seem unrealistic. In this area 100mph nearly always results in an automatic ban, the length of which can vary wildly...along with a hefty fine. You can only plead for mercy but you WERE after all doing more than 50 % over the speed limit so you should expect a good slap on the wrist at the very least. Put it down to experience.
Lost mine quite rightly so for 15 months � 1000 pound fine and a re test for dangerous driving, although it was 147mph on M65 on a motorbike, still you will probably get a 20-30 day ban and a fine depending on your financial situation which is allowed to be paid off at a sum you can afford per week or month. No personal circumstances will be considered as they took my driving license off me and made me take the test again even though I needed it!! Lucky i work from home!
It isn't an instant ban - it's at the discretion of the magistrate. I'm speaking from experience. I was caught doing just over 101mph on a motorway and I got 6 points and a hefty fine but did not lose my licence. I pled mitigating circumstances (I was upset over the imminent death of a relative) and had a clean licence and I these factors were taken into account. I also believe it helped that I spoke for myself in court and did not use a lawyer. However, if you get a 'hanging judge' then a ban may be unavoidable.
ICEMAN you are lucky you never got porridge mate !. That is just totally irresponsible. PS, you comin for a blast when you get your license back ? im lookin for a 1100xx !
Oh I have the license back tigga, just have a nagging girlfriend. They were going to send me down but was still on crutches so got off with no jail and no community service but a heavy fine. Just waiting till I am 25 then get my Duke ( dream machine).
I looked into this 5 or so years ago when i was copped doing 106. I got a �250 fine and 6 points. I was lucky because i should have got a ban. I think from memory, if you did between 30 and 40 over the speed limit (i.e. 60 to 70 in a 30 zone, or 100 to 110 in a 70 etc) then its automatic 30 day ban, more than 40 over the limit was a 6 month. I managed to talk my way out of the ban, so i also think they have powers to show leniency, hence the big-ish fine and the points. Best of luck.
