HELLO I WAS ON MY WAY HOME FRIDAY NIGHT AROUND 7PM I WAS DRIVING ALONG A STRAIGHT ROAD THEN THE ROAD SORT OF DROPS DOWN AS IF YOU ARE COMING OVER A HILL UP THEN DOWN SORT OF THING AS IVE COME OVER SOME GUY WAS DOING WHAT SEEMED TO ME AS A U TURN IN THE ROAD AND HIS CAR WAS ACROSS WAYS OVER MY SIDE OF THE ROAD HIS PASSENGER DOOR WAS ACROSS WAYS ON MY SIDE OF THE ROAD I WAS DRIVING DOWN HILL THE ROADS WERE SOAKED I BRAKED AS QUICK AS I COULD AND SLID STRAIGHT INTO HIS WING STRAIGHT ON MY AIR BAGS DEPLOYED I WAS TAKEN STRAIGHT TO HOSPITAL WITH NECK AND BACK INJURIES..WHOS FAULT IS THIS ??????

well its just a normal main road i only came through some speed cameras like 400 yards further back which didnt flash so couldnt of been going to fast surely
No point in questioning the motives of the other bloke, your insurance company will do that - just get it all documented and send off the information to them.
well if the speed limit is 30 and you, as you say were doing 35 then yes, you were going to fast, even more so as it was raining, or soaked to use your words, and it's not very light at 7pm either now
Let your insurers sort it out that's what you pay them to do
hang on, was he parked up facing up the hill when you first saw him or was he across the road as you say in first post?

no im just gathering he was parked up facing up the hill and hes u turned to go down all i remember is him shooting across the road he had a passenger with him which in my eyes restricted his view aswell and thats was it he came across me i had no chance

if he was already side on then must have been there a while, I'd say you are at fault for not slowing down when approaching the hill for any hazard there may be over it

and seriously, there could have been a dog/ deer/ child in the road.. you're supposed to be ready or such things.
Chuck and Doc are correct. You hit him and you should have been able to stop, no matter how stupid his actions.
I would think you were at fault. Regardless of what he was doing you should have been able to stop in time. If there had been a queue of traffic in your lane but over the hill you wouldn't have been able to see them either, but you should have been driving at a speed which allowed you to stop in those conditions.
even if he was dancing a naked jig in the car at the time, you hit him.

Unlikely, but:
Suppose, instead of a half-wit doing a U-turn, there had been several 2 year old children playing in the road.
Would you have hit them?
Whose fault would it have been?
If he was on the approach to the bridge there should have been double white lines! if he's crossed the lines, He/ She was at fault, go back & check the area, take pictures of your Approach, & the other driver take as much evidence as you can, any wittiness's, weather conditions, time, estimate your speed, where you came from ( Did you get a car park ticket with a time on it? this could help in estimating your speed, take a photo of your own car's damage get it witnessed & signed, all this is for your own evidence.
