Speeding Fine ???

My partner and I have recently received a speeding fine through the post after returning from a trip up North. We were doing a maximum of 70mph, the fine states that through a portion of the M42 we were doing 70mph through a 60mph limit. Can anyone confirm if there is actually a 60mph limit anywhere on the M42 - as we don't recall going through any roadworks or speed restrictions...what to do ?

if you go to the AA website and enter M42, it will show you speed restrictions as they are today.

okay, I kinda meant temporary speed limits, but I take your point :o)
The M42 became what's known as a "controlled motorway" in 2005, therefore it does not need to have, for example, roadworks in order to vary the speed limit. It has numerous and highly visible overhead speed advisors which you ignore at your peril. I would guess that this is why you "got caught"?

My answer gave a bit more detail because the poster seemed puzzled as to why they had been sent the speeding fine. I was trying to supply a brief reason as to why it may have happened. If that's alright with you of course?

On the other hand, we may both be wrong? Well, I might, eh?

I don't see why you and your partner should both get a fine unless you were in different cars and were both speeding.

Cant fight motorway speed limits.

Try asking for proof of who was driving.

The 1st answer from paraffin is spot on. Sounds to me as though you blazed down the motorway oblivious to any thing just thinking oh it's a motorway 70 mph that's it!

Can someone tell me - if you pass a gantry at 70 and it shows 70, and as soon as you pass it it changes to 60, are you still going to be booked for speeding?
we did exactly the same thing as you did by the nec, and we just wrote back and said that we didn't deny speeding we just couldn't remember which one of us was driving at the time as it was such a long and tiresome journey etc. etc. and after a few more frightening letters of intimidating crap we got away with it.
everyone in this particullar area knows that this section of the m42 is just a money earner, so when you put up a good fight / stumbling block unless you were doing 100+ mph you will usually get away with it.
