Can an ABH be settled or dropped if compensation is agreed?

I was wondering if I managed to get my solicitor to contact the victim, whether I can settledwit the victims outside of court. I know that there injuries are minor even thought it is an ABH. However I would really like to settle this without going to court or getting a convcition to save my job and my future.It is the first and only time have ever been in this situation. Is this at all possible, and if so how do I go about logging it with the local CPS or police station

I doubt it. It's a criminal case and it's the crown that brings the prosecution. Whether the victim wants to proceed or not now is irrelevant I understand.

Sorry just to comment on the last post I hit a 3 guys after my friend had attacked them after he was vocaly provoked. I stupidly got involved when I should have walked away. Unfortunately my mate did strike first and I just saw red as I just saw them in a tussle. I am hoping the CPS may take a lenient stance on me :-(

As factor says (rightly) you cannot pay to get out of a criminal case,or almost everyone would do it and the legal systen would fall apart.
Also as factor says,once the Crown decides on a prosecution it is no longer up to the victim to withdraw or not.
I am sorry,but I think you had better realise that this case IS going to court and will take it's course whatever you may wish personally.

thanks for the advise, I wasnt intending it to be blod money , its just that I did not realise that the case was out the accusers hands. I have spoken to my solicitor and he says the worst case scenario is a high community service, and a suspended sentence, I am grateful if it turns out to be that as it may mean I will be able to keep my job!

One last question.. At what point do I need to inform my employer? I am worried that I may lose my job over this before I even get to court and that will look even worse for me...

I would (personally) wait under the court case is over (whatever the outcome) to tell your employer.
After all if you tell them before the court case they may act as if the worst outcome had happened,when of course it may not.
No real point in telling them too soon.

rizpick. No one person on here can tell you exactly what will happen in your case. It is a group fight and there will most likely of been alot of complex situations that has resulted to your situation as it stands.

If it wernt for the injuries recieved by the other party then there would be no ABH so it is possible that if they withdrew their statements that the ABH charge COULD go away. As these guys say, the ABH charge COULD stay, it COULD be dropped to affray, or the case COULD be dropped all together.

You are most likely to get you best results from sitting down with your solicitor and having a looong chat. But yes, you do have a certain degree of control (maybe slim) and some options avaliable to you.

These guys on here might know a little bit about the "book of law" but they know absolutley nothing about your case or you as a person.


This is the reason you get fools like cassa333 and lucythomas7 making stupid comments about things that they know nothing about... People that are sheltered from the goings on of the real world.... are narrow minded.... cannot stand up for themselves, families or friends ect ect.

Like standian says, anything could have happend that night.

Oh and nearly forgot, I am in a similar situation where I am being charged with GBH. No previous convictions and lead my own happy/succesful life. Im not guilty of any 'unlawful' violence what so ever but I guess i'll just have to wait and see how great the british justice system is.
