Hi, I have been charged with Careless Cycling by the Police. I have received the summons to appear in court and also the statements from those involved. The statement from the Police Officer is unsigned. Does this make it inadmissable in court? If the Police Officer appears in court can he then sign it therefore making it admissable?

Part 2 - I was knocked off my bike by a driver who was driving without a valid MOT certificate (I was trying to pass him on the left and he then pulled over to the left without indicating). Does this have any impact on the offence I am charged with i.e. careless cycling?

Will these people receive Custodial Sentence or Suspended Sentence

Yes, it's a typed copy.

The statement is perfectly admissable. You have indicated that it was a typed copy, and the officer will have written his or her name along the top which is an accepted form of their signature.

As for the offence of the MOT certificate on the vehicle, it has absolutely no bearing on your charge whatsoever. It would bear any remark on your charge if the fact of the driver not having an MOT caused you to cycle in a reckless manner.
