Made Redundant and job readvertised 2 months later !!!!

I would really appreciate any guidance with this, violins at the ready..

Myself and 9 Colleagues were made redundant from a large Estate Agent in December 2009 , we worked under the umbrella of the Estate Agency for a small Mortgage Company, and our redundancy letter says that due to market conditions the company could not continue. We didnt receive any redundancy payout other than the statutory minimum for people that have worked there over 2 years. Nobody worked there less than 1 year..

We have now discovered that the company has declared on Mortgages Strategy that they made profits of 54.1 million, and they are now recruiting 90 new Mortgage Advisers !!! The most annoying part is our managing director that laid us off is now "head of mortgages" for the estate agency.

We are all considering completing the relevant forms and sending them to HR and ACAS employment tribunal, Are we right in thinking we have a valid claim? Many Thanks

I experienced a case where the person being made redundant saw 'her' job being advertised externally during his redundancy consultation and within a few weeks someone ( a friend of a senior mager) was appointed. But the new job was said to be at a lower salary, reported to a different person and the job description was written in such a way that the employer could say the job was sufficiently different. But sure enough a few months after the redundancy the new person's role was expanded and the salary was increased substantially.
In your case there may be a genuine change in market conditions or the role may be regarded as sufficiently different. Having seen an employee shafted I wish you luck with any claim , but maybe you should consider whether you would really want to work for them again, and whether any compensation would be worth more than your severance pay.
The job's got to be different, it's the job that is redundant not the person. Are you in a union?

no union unfortunately, but 5 of us definitely want to take it further. The job description is the exact same- we were mortgage advisers and they are taking on 90 new advisers !!!! We didnt get any severance pay either....
