whay will happen if my niece retracts her statemant?

i had to ask my niece to home to my house at the weekend as my boyfriend was being drunk and disordaly, the police were phoned and my niece gave a statement against him, now she wants to retract her statement. what will happen if she does that???

If the police (& CPS) believe that what she said simply wasn't true, she risks being charged with 'wasting police time'. Such a charge usually leads, upon conviction, to a hefty fine.

If the police (&CPS) believe that what she said was true, and that she's now backing down to try to prevent your boyfriend from being prosecuted, she risks being charged with 'attempting to pervert the course of justice'. That's a very serious charge, which usually results in a prison sentence.

Either way, the CPS can continue to prosecute your boyfriend and still use the original statement in court. (If the events that took place fall into what the CPS regard as 'domestic violence' it's actually their policy, in most circumstances, to do exactly that).

Im not sure im getting the full picture here? so you and your boyfriend dont live with each other, and your niece was with your boyfriend at the time, at his house?

So you then went and got her and you both went back to your house?

Im sorry but how old is your niece, and has hes drunk in his house that in its self isnt a crime, unless he becomes violent in any way or goes outside and starts be disordaly.

As for retracting her statement it wont matter as its a domestic and im just guessing but im sure youre niece is under the age of 18 so with that taken into account the cps will still go with it.
