abh to gbh ??

I have been to court today originally on an ABH s47 charge but now they have informed me it is now a s20 as they have more medical records for the so called victim. the funny thing is this has been going on since october last year and they have only just come up with the medical reports for him and the prosecution told my solicitor on the previous visit to court that this could all be dropped or a lesser sentence because the evidence wasnt cosher. then i find out its worse going up to a s20! Were the prosection lying to build me up and knock me down?

to the answer above i am requiring sensible answers not judgemental ones as you know i have not explained the situation so your commenting on something im not asking is not helpful thank you
probably not lying as such. It seems incredibly unlikely the prosecution would undermine their own case by telling your side that the evidence was rubbish. Anyway, if they hadn;'t seen the evidnece then it was true that the charge could have gone down, as its also true the charge could go up, as it has done

Obviously if more evidence comes to light during the time you're on Bail, the prosecution, unfortunately for you, are entitled to "up" the charge, if you like. The fact that it's taken some time for the medical records to be brought up to date is just one of those things which happen. It may well have been one of the reasons why your case has dragged on for 6 months?

I'm not sure what you mean by "the evidence wasn't cosher."? Could you elaborate on that, please?

The prosection told my solicitor that the case was either going to be dropped or i would be given a lesser charge. As the evidence would not hold up in court, the evidence is a video camera which only films me assulting the "victim" it took the police a month to get hold of this tape and my partner who was also involved is convinced that it has been tampered with as things arnt as they were in reality comparing to the tape.

the other evidence is the statments they are all of the "victims" friends or family they are all complete fabrications and in one way that video has proved them to be liers in another its going to be the icing on the cake for them.

my solicitor didnt know what it was that made the prosection say that the things - The reasons that i have stated is the things i believed it could be.

so now instead of it getting better its getting worse and im looking at going to prison all because nobody will stand forward and tell the truth.

Only just spotted your last post: You and/or your partner may believe that the video evidence has been tampered with but not only is that an extremely serious allegation, how would you go about proving it, and who are you trying to say "tampered with it"?

Obviously your version of events will differ from the other side which doesn't surprise me one bit. Only the Court can ultimately decide one way or another. And put it this way, if anyone is found to be lying, for whatever reason, there is the possibility that they could be found guilty of perjury, basically lying under oath, a serious offence.

It would appear that the video evidence could be the reason why the more serious charge has been mentioned. What exactly have you been charged with? S.47 or S.18? It could make a significant difference were you to be ultimately convicted. And are you pleading guilty or not?
