An elderly parent wants to transfer ownership of his property in Scotland (A flat appx value �50,000) to his daughter at no cost. However, her father has an unsecured loan for �17,000 which is not in arrears, but I believe there is a danger that this could happen in the not too distant future due to ill health. Would this be seen as disposing of assets in the face of the potential of not being able to repay the loan and make any transfer of ownership invalid? Or worse still an offence if the loan was not declared to a solicitor completing the trnasfer?
