I have received a letter threatening me with legal action if I do not pay the amount requested - however I did not request nor have I received the product for which they are demanding money. Is their action illegal?

What an odd question.

I have not ordered a product.

I have not received a product.

Do I have to pay for it?

Weird

Oh cr@p, I just thought ... I didn't have one of those either !!!

Do I have to pay too??

How much do I have to pay?

Are you people actually able to read or do you just fire off obnoxious replies without engaging what feeble brains you must have - at what point in my post did I ask "Do I have to pay for it?" I asked whether the company has acted illegally by threatnening legal action.

no. and if they keep insisting then report them to the police. probably just scammers

They are allowed to ask you for money (as long as they are not trying to obtain money by menaces, of breaching the Malicious Communications Act.

You, on the same basis, are allowed to reply ...

"Dear Sirs,

... F*ck Off.

Hi - they're not scammers- I have received goods from them previously (gas bottles, paid for upon receipt) however they sent me a bill last month for gas I had not received (or asked for) and I raised this with them - they promised to sort it out . However I have now received a letter threatening to take me to court unless I settle the account. It is obviously a clerical error, however whilst in discussion with some friends, someone raised the point that it was illegal to threaten court action if thismoney wasn't owed so I decided to ask here.
they think it is owed. they can take legal action, and then they have to prove it in court!

Question Author
Not anymore they don't - they have had a good flea in their ear from me. I think they are not blessed with decent clerical staff as they have also continued to send bills for the previous tennants despite my 4 letters informing them that those people have moved.
The question was one of curiosity.
oh so you wont get to watch them make fools of themselves in court then, if it had come to that.
Question Author
tempting though it was...
In short.....Yes you do have to pay ...and send me the same sum at once.

Seriously
Are you stupid and have more money than sense.
Why should you pay money you do not owe.
Question Author
keithlbw- I reiterate a previous comment - at what point did I ask whether I should pay? That was NOT my question - my question was whether the company's action is legal. I really think you need to learn to read the questions properly - and the subsequent comments, before embarrassing yourself with posting childish, rude and ignorant comments.
I think it depends. If they are scammers and were threatening you with court action and they knew that they were just trying it on then it would be illegal and you could report them to the police.

However this gas company has made a **** up somewhere and genuinely believes you owe them money. So they are not making empty threats as in their eyes you have had the gas and wont pay for it.
