full custody and residency order

I have a friend who has a 3 yr old, she split from the childs father 2 yrs ago when he left her for another woman, and they have been argueing ever since, he took her to court for acess and visitation rights etc, they have a court order saying he has her every other weekend Sat till Mon and every wed with every other wed stop over. Now she has just decided to move back to her origional home town, an hour and a half away, she told him and a day later she recieved a letter summenings her to court because he is appling for full custody and a resedency order. Just basically wanted to know what might happen and if he will get full custody or if they can stop my friend from leaving town? She is not a bad mother so that is no reason!

On what basis is he seeking the residence order? The mother of the child cannot be stopped from moving around. What I will suggest is that he proposes to have the 3 year old every other week, half term, summer, and alternate occasion like birthday, christmas and easter.

If there is a risk to the child from the mother, then yes he will be granted the residence order

I think hes seeking the residency order because he doesnt want her to move away with the child.
I think this could be a little bit difficult. What he can say is he thinks the move is more likely to affect the child's school (that is if the Dad lives neaer to the school). Residence Orders are usaully granted when the child stands a high risk.
