X BOX 360 BROKEN where do we stand?

My stepson is devastated, his mum bought from argos (dec2006) and still has the reciept (which she,s given to him) apparantley his mum has been told by argos that she needs to sort this out with micro-soft and not with them.How can this be, when it has a one year warrenty, hope some of you clever people can help??

as far as I am aware Argos are trying to pull a fast one! When you buy goods from a shop you have a contract with them so they are the ones who need to reimburse you not microsoft, especially when it is under warranty. I suggest you go back and speak to the manager and say you want it exchanged or refunded and don't be fobbed off. Goods have to be fit for their purpose and 6 months down the line is not a reasonable amount of time for something like this to last.
Your contract is with Argos, not Microsoft. They must deal with Microsoft for you. However, as this product is more than 6 months sold, they are within their rights to arrange for a repair rather than a refund/replacement.
check your warranty, you will probably find it is a manufacturers warranty and it will explain what to do if a fault occurs.

thanks guys!!! Unfortunatley the all the packaging was thrown out by his mum, my stepson reckons she wont even know what a warrenty is! so all we have is the argos receipt. Ill pop to my local argos in the morning and hopefully they will offer to repair or replace it! Thanks once again guys!

Hiya i have just checked this out with my bloke coz he has same computer and yes argos is correct its microsoft you have to go to, his mate had to send his back and it went back to microsoft, unfortunatly that is only way your going to get a new computer.
Same thing happened with my sons X Box 360. He rang microsoft . They gave him a reference number. He then had to box the X Box up, (not in original box) so you will be OK there. A courier collected it, and it was returned again via courier within 12 days.
Yes Microsoft might offer to help, but legally your rights are against Argos. if you go to Microsoft, you can only expect them to offer what it states in the warranty. You will probably have more options against Argos.

Don't get legal rights and warranties confused as they are completely different.
