My ex partner has decided to take me to court for an access order for our 1 year old daughter. He has never bothered about her until now and as you can imagine, I am so angry and its going to cost me a fortune. He knows this and when I phoned him at work (the only contact number i have), we really argued and i may have said a few things out of turn. I think he may have recorded me to use as evidence. Can this be presented against me? I too have crime numbers for a domestic incident, criminal damage and his new partner sending threatening texts against myself and my daughter. Can any of the above indidents be used against him? Please help!! Thanking you in advance Jane

my friend went through the same thing when she had her little boy, unless he has been violent towards your daughter courts will pretty much give him access, will start off as supervised and work their way up, obviously it would be better to agree to something as he is her father and every child has a right to know both parents
Did he make you aware that he was recording the call and might make this recording available to a third party? If not, muy understanding is that he will be unable to use it in court.

There's a little detail - though not quite covering your situation - here: http://www.ofcom.org.uk/static/archive/oftel/c onsumer/advice/faqs/prvfaq3.htm
