does a finance comppany have a duty of care to there customers

i have written several letters to my car fianace company, none have received an answer, could anybody please advise if they have a duty of care to there customer and can it be classed as negligent

Have you sent them recorded delivery, so you have proof of receipt?

yes have sent them by special delivery and have copy of signed delivery ticket from royal mail

Is the agreement a regulated agreement - ie is it for under �25,000 and is it to a person as opposed to a limited company)

What exactly are you trying to sort out?

The agreement was for less than �25k, I have paid more than a third of the price of the car and I came of work sick, I am covered by sickness insurance but they are messing me about so no payments have beeen made on the care, I have started the payments, the finance company don't want the car back but want the security of repossesing the car if I don't pay, so they are taking me to court to apply for a repossession order should I not pay they can come and snatch the car, I am defending the case by stating they ignored my letters with offers of payments when I first went sick and a secong letter asking them to reply, the judge has given direction that I have to prove to the court that they have failed in ther duty of car to me.
Okay, I understand now, but being honest it is above my technical expertise.

The best thing I can suggest is contact a local solicitor and ask fro a free half hour consultation, get all the paperwork ready and all the questions, they shouldbe able toput you in the right direction.
