At what age can a child be done for assault?

I have a child at Primary school who has on several occasion's been assaulted by a child who is 11yrs of age, the child in question, has assaulted severasl other children within the school! There is a younger brother too who does the same.
The school does not seem to be taking on board our concerns. In Scottish law where do i stand if i wanted to have this child charged with assault? Any help on this matter would be very much appreciated!
Oh and we are not just talking about a wee slap! we are talking about really laying the boot in! so to speak, and also trying to strangle children.

The age of criminal responsibility is 10. The law says that a child under this age cannot commit a crime. You could report the matter to the Police but in reality I suspect the most they would do would be to have a chat with the offender if he's only 11. If it is happening at school, the school have a duty to become involved. If you get no-where with the staff, tell them you're taking it further and will report it to the education department. You could get them really worried by threatening to go to the media. Whatever you do, don't tackle the parents. If the kids are violent, it makes me wonder where they learned it from.
I have been down this route with my daughter who was continually bullied and threatened. The school and the education department was about as useful as a chocolate teapot. Report it to the police and insist that they take a statement. They have to act upon it.
You can also sue the school, might be worth having a chat to the C.A.B.
I would, for the record send a recorded letter to the school stating everything that has been going on and the lack of help received from them, and send a copy to the school governers (if this applies in Scotland) and to the education dept. Ask the school for a copy of their anti bullying policy and the health and safety within the school. Also ask for a copy of your daughters records in order to check whether or not these incidents have been recorded. If nothing else it may worry the school enough to take you seriously.
Don't be intimidated by them or the police, they both have a duty to protect your child. Hope everything works out OK for you. I eventually got my daughter transferred to another school after involving our MP and begging the other school to take her on!! Good luck
