How would the law be applied to smoking within a residential home for the elderly when the ban on smoking at the workplace comes into legal effect in England later this year? Bearing in mind that its classed as a residents private home and is also a workplace for the carers

As it is a residence, the law will not apply.

What premises are exempted?
The ban will not cover, prisons, hospices, care homes and mental health units where patients are held in secure conditions for more than six months, as they are places of residence.
As a point of interest , I'm told the ban even applies to private houses when a tradesman is there so for example if you have a plumber working in your house you cannot smoke. Do you know if this is the case Ethel or urban myth?
