hi, just a quick wonder?
my nephew had an argument with his girlfriend ,she attacked him in his own home, but with her 2 yr old son in her arms ,my nephew grabbed her arm and slung her out, to get back at him she had him arrested on assault charges but not just on herself on the 2yr old boy too!
hes now due in court and is worried sick
she has admitted to me that she lied and he never did it and has told me she has dropped charges but its all still going ahead now he has to prove himself innocent!!!!HOW? WHY?

He hasn't been proven guilty yet - so he is still innocent.

Accompany her to the police station so she can retract her statement.

The prosecution must prove your nephew is guilty - he does not have to prove anything

It is not up to his girlfriend to drop the charges - that decision is out of her hands. She can go to the Police station and retract her statement but the prosecution may decide to continue anyway

This is a domestic violence allegation and as such will be prosecuted robustly

this is what scares me he has aspergers and does not understand what is going on to be truthful but because he is now of adult age (19) he has no medical representation !
and will be easily led into saying anything

and i have tried to get her to go into the police station with me but she has moved over 200 miles away and wont come down here so she said she has been into her local station and retracted the statement
i just dont know how to help him
I am not a legal professional but I have read questions like yours on AB before. From what I remember from previous questions, if the incident was not witnessed the only evidence the prosecution has is the witness statement given by your nephew's ex. If she has subsequently withdrawn it then the prosecution will have no evidence and the case will be dropped.
