Deed of assignment in divorce

I have downloaded this deed to pass to my husband's solicitor as mine does not deal with conveyancing. Is there a need to fill in the schedule part at the end? Have had mine witnessed and have left date blank as don't know when ex will turn up. Any catches or small print I should add? Have appt. at C.A.B. but may need to submit before then.

I'd get independant legal advice to make sure everything is as it should be and you have covered yourself appropriately and to make sure any other appropriate docs are in place such as any licences to assign required.

Thank you Jenna1978. Will definitely check this out. What sort of licences do you mean? Is this relevant to a mortgage? Woolwich/Barclays say there will be no problem and I can do Land Registry bit myself after this deed is done.

Depends on what is it you are assigning..a lease?

Dear Jenna1978,
I am drafting a Deed of Assignment to change the house from joint to my sole name and also another to transfer the mortgage endowment policy the same way. Both of which my husband has agreed to in the Consent Order. Got deed from clickdocs.co.uk. Just thought of asking my own ins. co. for forms but don't know if I have time to wait as they would not send me requested forms earlier as they are in joint names with hubby named first and as he's no longer living here, they would not forward them!!

Hi, I tried to have a look at it but I can't view it for free.

See if someone at your husband's firm can give you independant legal advice, a separate solicitor not involved in your husband's matter may be able to do to get things done. May be worth asking or they may be able to arrange for someone to see you from another firm.

Check if any other docs are needed such as any licence to assign/consent if it is a Lease you are assigning and also that any mortgage issues are sorted.

It's hard for me to say without seeing the docs.

C.A.B. sent me to a "free half hour solicitor" who looked over the forms and pronounced them unfit : would I like to make an appointment and they would send me a letter informing me of their charges etc. etc..........mentioned the stamp duty form was 99 pages long and I said I was good at filling in forms thank you, but he replied things have changed a good deal since you did your own conveyancing in 1987!
No such thing as a free lunch I suppose!

Better to be safe than sorry though, it can be a lot more complicated than people think and that's what lawyers are there for.

Can be better to spend a bit now to prevent a mistake that could be more costly to rectify in the future.
