How do you go about getting this - my step father is losing his memory and often gets confused. If he was to be registered as senile would that allow my mother to have it

i don't think there is such a thing as "registered senile"
You have to go to a solicitors and get a power of attorney drawn up, it isn't just automatic if it is decided that someone is mentally incapable of looking after their own affairs.

What do you need to take to the solicitors to prove that someone is mentally incapable of looking after their own affairs. He is certainly incapable of looking after himself and cannot be left alone
Surely if the power of attorney is granted voluntarily, you don't have to prove senility/incompetence?

In order to execute a power of attorney he must have the mental capacity to manage his own affairs. Once a poser of attorney iks executed, provided it is in the form of an Enduring Power of Attorney it can be used straight away, but if he then becomes incapable of managing his own affairs the Power of Attorney msut be registered with the Court of Protection. All you need to know is at the Public Guardianship Office website www.guardianship.gov.uk/
