It's likely that you'll have to employ a solicitor in order to obtain a Section 8 Residence Order but, in the first instance, I suggest phoning Parentline Plus for their advice:
0808 800 2222

Your local Family Court (which is normally part of the Magistrates Court) may also be able to provide you with some advice about the procedures. (Some people have an automatic right to apply for an order. Others have to seek 'leave to apply' first).

This site doesn't directly answer your question but, if you read through the information from each of the links under 'Residence Orders', it might give you a better understanding of what's involved:

Hi,

you don't give too many details so in light of that i would suggest you get yourself a good solicitor and apply to the court via them. If the other parent then objects, you have a solicitors view already.

you can do this without the solicitors help, but by personal experience, i wouldnt chance it.

sorry to sound so negative, but better to be safe then sorry eh?

good luck
