My sons GF ordered a shop with Deliveroo, for her mother, that included £30 worth of tobacco.
Said order was dropped on doorstep minus tobacco.

Numerous phone calls later, keep getting told that small print requires signature for age related product (fair enough...she wasn't home at the time of delivery).
However, thats all we are getting.
Keep on asking about a refund or tobacco been delivered and been told that its in the small print about age restricted items been signed for!
Manager rang back & when asked about a refund or delivery promptly terminated the call.

EH?
Surely a company cant retain £30 for an undelivered item?
Any advice/help appreciated

(All a bit of a ball ache with everything been on line nowadays, used to have a Trading Standards Office on my door step at one time)

My view is that your son's GF has no recourse. She (or someone over 18) was not there to sign for age restricted products. Consequently, according to the terms she must have accepted at purchase, Deliveroo are entitled to charge her and not deliver the product. Exactly Smow, fact is my sons GF is now £30 out of pocket and Deliveroo wont replace either the goods or the money.
Apparently its in the small print.

MM, it need not be returnt to the store. It states on their site,

"For any age-restricted products that can't be delivered because the customer is underage or doesn't have ID, please dispose of these responsibly. You don’t need to return them to the restaurant or store, but you should not:

give them to anyone under the age of 18

dispose of them somewhere they are likely to be accessible to anyone under the age of 18

sell them on to anyone else

give them to anyone who is already drunk

If you can’t deliver part of the order because the customer doesn’t have ID, is too young, or is already drunk you'll still be paid the full fee for the order, and we’ll contact the customer directly."

My view is that your son's GF has no recourse. She (or someone over 18) was not there to sign for age restricted products. Consequently, according to the terms she must have accepted at purchase, Deliveroo are entitled to charge her and not deliver the product. Clearly they attempted delivery by reason of the fact that the other items were delivered. You have accepted she was not there. I do not see there is any recourse whatsoever.

It is not a scam. It might be a sharp way of carrying out business but it is not scam.
Deliveroo hasn't got the £30. The shop/restaurant that sold it has the £30. Deliveroo has its delivery fee.

Will the tobacco be resold?
If you order and pay for goods to be delivered by Tesco they are supplied by Tesco and delivered by Tesco. The driver returns to the Tesco base and can return rejected goods in a fit and proper state to be re-sold.

When you buy through Deliveroo, they are only the collection and delivery service. Their drivers and riders do not return to the outlet that supplied your goods. They are not paid to return to the outlet and it would cost them time and money to do so. I can understand their policy. It's not their fault your son's girlfriend was not at home

As for the fact no one was home to take the delivery in the past we have phoned the shop and told them that we were unable to take delivery of shopping and they returned it to the store and redelivered it the following day
nailit, the delivery person kept the tobacco to do with as he wished. He is not allowed to sell it but can keep it or gift it to anyone over the age of 18.

also, as deliveroo drivers are self employed you have no beef with deliveroo either

Might become a Deliveroo Driver now and keep cigs, alcohol, knives, scratchcards, etc to myself.

No it wasn’t but I was giving an explanation of an emergency as the op said an emergency had occurred which is why they were not home
