If your solicitor agrees you have massive grounds For an appeal as during the trial not all the evidence was presented to the court but your barrister who you believe did not represent you to his best ability advises against the appeal! where legally doesn’t the defendant stand and what can the defendant do to assure they are being defended fairly!!! Even though the defendant is claiming legal aid can someone please advise if the defendant can challenge the unfair representation??? Or even if there is some sort of human right because at the moment it feels as though because we are a family who are not well off we do not deserve the same legal representation!! And to make matters worse the defendant was set up, no previous, no evidence a pillar of the community who was sent to prison on the word of a hardened criminal!!!

Ask the solicitor if it's possible for them to instruct a different barrister. If they say no, apply to the court to change BOTH solicitor and barrister, using this form: https://www.justice.gov.uk/courts/procedure-rules/criminal/docs/october-2015/rep001-eng.pdf

The really best chance of acquittal has gone
It was the first case

"My lawyer was crip" appeals were previously not allowed but since a few cases, they can pursued - the bar ( ha!) is really high and the test is - was your lawyer so crip as to make it unjust ?

and there is a rough review here
https://www.kingsleynapley.co.uk/insights/blogs/regulatory-blog/case-update-appeal-on-the-basis-that-counsel-was-so-incompetent-that-the-hearing-was-unjust

As family, you are bound to think that the convict didnt do it and it HAS to be due to crip representation. But he may have done it tho'.

I agree with Chris - neither of us are lawyers and charging for this that you should go back to your original solicitor.

He may say he cant get legal aid for such an appeal - and that therefore you have to pay for it yourself. If it is your own money you have to be pretty careful about how you spend it.

you will have realised by now you cant get much done on Legal Aid.
