Hi , I Own My Home And Intend That After I Die My Disabled Son Should Be Allowed To Live In It

Then it should pas to his nieces and nephews . I am now worrying that should I become unable to look after myself and my son I would be forced to sell up to pay for my care . Can anyone please give me an answer ?

LINCARE what may be more difficult, even possibly impossible is ensuring that his nieces and nephews can inherit. I am thinking that he might need care in his turn and unless he has a dependent living in the house, then the house could be included in his financial assessment. I am not sure if this is right but possibly putting the house in trust for your...

Hi , yes he does . He is brain damaged after an accident when he was 20 and I have cared for him since then . He is now 48 and I am 69

Under the plans which are scheduled for introduction in 2016, "for people entering a care home, their property will not be included in the assessment of assets if a partner or dependent still lives in the home":

As Buenchico says. This may also be the current situation in your area already Lincare. It may be worth checking with CAB or your local authority how they define a dependent relative, it may be that the dependent relative has to be in receipt of certain disability benefits.

I am not sure if this is right but possibly putting the house in trust for your grandchildren with a lifetime interest in your son might do it but I am not a legal beagle and you will need proper advice.
