can benefactors sue a hospital

My brother and I together with a solicitor are executors of my aunts will. my brother wants the estate to sue the hospital because they moved my ain't into s home without following their own protocol. can we do this?

Why not ask your solicitor? That's what he's there for.
You can, but it will cost you a fair amount of money. What is your loss? Did the move bring about your aunt's death and can you PROVE this? (Even so, the damages will not be significant unless either of you can show you were dependent on your aunt).

And do the beneficiaries agree to you suing?

I appreciate you must be very angry, but I think you are unlikely to gain anything. Could you not go down the route of writing a strong letter of complaint or having a meeting with the appropriate manager?
I have a horrid feeling that this might be about the amount of money paid to the care home (and hence a reduction in the amount going to the legatees) ?
do you mean benefactors? or beneficiaries?
The OP means beneficiaries bednobs, but this is a common error.
