My ex was done for ABH against me in 2009, it went to crown court and he received an 8 month sentence suspended for 24 months plus a tag and curfew! His suspended sentence ended mid Jan this year, 2 weeks after his suspended he beat me again although we were not together we have a young daughter, this time he has pleaded guilty to two accounts of assault and one of criminal damage, he is due to be sentenced tomorrow, what is his likely sentence?

6 months, if the judge is in a good mood.
4 or 5 years hopefully.
If there is any possibility of moving, please take it.

Its only gone to magistrates court this time so dont think he can get very long!
The maximum the Mags can give is 6 months. Given his previous I would think a custodial is quite likely. He will however get some discount for a guilty plea.
Ok somhe's going to prison for a few months pippy, use that time to move away, start a new life away from where he will be when he gets out!........look after you and your daughter!.......this your chance to have freedom from him!..........Take it!........
it hardly seems worth a custodial on the face of things. Not because i think what he did dosent deserve it but because with the discount he could end up in prison for a few weeks.
I'm not sure thats enough really, and it'll be over very quickly. Perhaps a high level community order might be more tough for him
hopefully he gets years thats disgusting what he has done you have a child so u need 2 keep her safe and if that means keeping him away from your child then so b it he dont deserve to b a dad 2 your child once he has hit u he will do it again and again and again it will go on untill u stop it get out while you can i have been there and it took me along time 2 getout and am only 22 please for your childs safety please leave him 4 good and he will get 2-3 years but will do half of that sentance so if he get 2 years he will do 1 yr an if he get 3 yrs he will do 15 months x
it is indeed true that Magistrates can only sentence up to six months but if they feel that 6 months is not enough it will be referred to judge and jury tomorrow and they will make recommendation for a longer sentence. They will take into account that the last sentence did not act as a deterrent. Get rid if you can.
No, it won't go to Crown Court, jim.

Common Assault and Criminal Damage (assuming the value is under £5k) are "Summary" offences for which the maximum sentence is 6 months custody. Committing to the Crown Court for sentence is not an option.
sorry new judge did not read the posting properly - shame though! Wonder if he went to prison or not - very much doubt he will - another suspended sentance I bet. One more chance, last chance, very last chance and then very very last chance!!!!
