tree roots - who's responsibility?

My next door neighbour has a big conifer tree in his back garden, just the other side of the fence which seperates our gardens. The roots are now pushing up my patio slabs making them uneven and a trip hazzard. I did mention it to him a few weeks ago as we do get along and he said he will take a look, but he hasn't as yet. Where do I stand on this one?
