Will I be charged with ABH.

I recently had an altercation with an neighbour whereup he accused me of something I hadnt done and didnt know anything about. He is not the most savoury of charaters, doesnt work and hasnt for along time, smokes drugs and is not the type of person i would associate with. He was very abusive to myself and my partner for no reason and at one stage removed his jacket and tried to provoke my partner into hitting him. I did at one stage push him back slightly as he was right in my face shouting and swearing and I became very intimidated. Myself and my partner walked away from the situation and went back into my property and just thought what an idiot. Some 5 hours later the police arrive at my property and state that the neighbour has accused me of hiting him which has caused a 1 cm cut below his eye and I am then arrested taken to the station and questioned. I am now out on bail pending futher investigation. There are no indepdent witnesses, the only witness being my partner and my neighbours 2 children which are very young. I have never been in the trouble with the police before, have a good job and am a responsible person. I am now really worried that they will charge me with this and I could lose everything.

He actually stated that I punched him at a force of 8-9 out of 10. However I have no damage on my hand and I also wear falsenails that are still totally intact and no marks on my palm where the nails would have indented if I had made such a punch. The police did check my hands for any signs of injury.
Your word against his, not enough to prove guilt if you ask me.
hope things go ok it is ur word against his n hopefully the police wont have enough to proceed

Yeah told the police about the drugs and he is known to the police as well for possession of drugs among other things.
Police behaviour in this country are really abusive. There is no police in the world so much abusive that this police. If you get in trouble they ask you to fill an application form and join them. Facking arrogants!
As has been stated, it seems a case of just your word against his, and as this man does not sound the type of person the courts would class as an upstanding citizen they are unlikely to take his word against yours, so I would doubt very much this would result in you 'losing everything'. As you say, you have a clean record and a 'good job', whereas the courts are not unbiased and the fact this man does not work and also is known to use drugs will not work in his favour, especially if he has a criminal record.

I am not saying I agree with that type of prejudice, it is my view they should deal with the case as it is and the evidence they have of it, whether or not he works or what he does in his spare time in my view should be immaterial..... but that is not how the courts think. ....but from what you say he sounds an unpleasant character so he does not gain my sympathy either. Sounds like he has a touch of drug induced psychosis and could do with some help!

Have you told them about his endless provocations and admitted to pushing him on that one occasion? If you do so it may work in your favour, as they may be then be even less likely to doubt your word.

Hi SnowQueen yes I told them everything and that I pushed him away, I told the truth unlike him.

You will be pleased to know that I received a call this morning form the officer investigating the case saying that they have decided there is no case to answer and everything has been dropped. The officer even apologised to me for taking 10 days to sort it out and that they where only doing there job.

Hopefully something good will come out of this as they now know about his drug issues and I think they will be keeping a close eye.
