my brother came home today to be told by my mother that the police had been on the phone and that he was to report to the local police station by 11.30 pm tonight to be interviewed and have his car ceased and crushed beacause apparently or so the police say there was witnesses to say he had been speeding the previous night. The police did not see him speeding themselves and are going liturally by what witnesses have supposidly reported to them. My brother was not speeding or driving where the police are sayin the witnesses told them an he himself has many witnesses to say he wasnt including his girlfriend who was in the car with him at the time. the police have been constantly on his back ever since he passed his test in april this year stopping him about 15 times so far to do 'checks'.And each time he is never charged with anything. It seems as if they have taken a dislike to him from the moment he passed his test. He was even stopped twice in one night by the same police man just for checks! What i wanted to know is can he actually have his car ceased and crushed simply by just supposid witnessessayin he did something and not the actual police seeing him doing it. He never did it and its causing a lot of upset because he never seems to get a minutes piece from the police. Also does he have to report to the police station, he is not well has work at 6.30 in the morning, surely if the police want to see him and take his car off him they should be making the effort to come and see him at our home. He is only 19 and me and my mum arent very clued up with the police and there laws, can anyone help and give me some advice? many thanks

Police Officers don't usually start their shifts at 11.30pm..........

i havent legged it!god some site this is you come on as a genuine person asking for help and get a whole load of stick for it!!!!!! i thought it was to help people out. think your right a solicitor may take me more seriously
What is different up where ?
I couldn't care less whether this is a wind up or not. My advice is NOT to go. The police cannot compel you to do so, so I would tell them to get stuffed.

well i guess i must be ver dim then! thanks barmaid after all that thats all i wanted to know.
gina1984 Lots of people seem to be getting on your back here. Everyone if someone asks a question, you should at least assume that its a genuine question. Gina, Im a former police officer and I can tell you categorically you DO NOT have to attend the police station. Unless you are under arrest, on bail or under a court order to do so, the police CANNOT insist that ANYONE attends at a police station. They can and do ask people to attend (I have done so many times) but all it is is a request. If I were you, Id forget it completely. If the police want to talk to you, your mother or your brother, believe me, theyll be knocking on your door, not asking you to go to them. Relax and enjoy your Saturday night.
Ya know what sounds strangest to me? The police crushing a car for speeding! Surely they would not be allowed to do that?
They can issue a section 59 notice for anti-social driving, another within 12 months means the vehicle can be seized and only released on payment or disposed of if not paid. Police reform act 2002 chapter 30. No idea how they go about it though.
Any chance of an update Gina?
What happened then?
