i have a friend who has been charged with abh.it was a neighbour dispute and the neighbour claimed to have been punched in the face, there was bruising to the face and chin and 3 lower dislodged teeth. it was heard in front of a district judge in a magistrates court.it has been delayed 1 week for a probatio report.she is 43,has an 18 year old daughter she is putting through college, is married and is in full time work.
is a custodial sentance the likely outcome.what is involed in the probation meeting.she is so worried.also her house has been sold and she is moving away fro the neighbour shortly.

Does she have previous?
When deciding on the probable sentence the judge will take into account the reccommendations of the probation report ( for which your friend will have to have an interview with a probation officer who will listen to everything your friend has to say). Although the starting point for sentencing is a custodial sentence if your friend is of prvious good charachter and pleaded guilty at the earliest point in the proceedings a custodial sentence is unlikely far more likely to be a community order.

she pleaded not guilty becaue she did not do it, the injury was caused by the other persons flailling arms but,the judge chose to beleive the victim because of the injury rec'd.
because she has pleaded not guilty is a custodial sentance lkiely ??

how much influence does the victim have on what the punisment/sentence should be?
