90 days notice......Help please

My contract with my firm ends on 31/3/10 we are being Tupe over to the new firm.I have already been told I am being made redundant as they run everything from head office in the West country. I understand if 20 or more are being made redundant we will be given 90 days notice. Can I start a new job while on the 90 days? I cannot work it as they have no position for me.

It's worth asking your employer. You have to be careful if you are banking on a redundancy payment- there is a risk that the employer may at the last minute ask you to stay a bit longer or find suitable alternative work and if you have already taken up another job you may lose your redundancy.

Thanks I am looking for work I can't see them asking me to stay as on as I live in Lancashire head office is in the West country.
I don't think any employment adviser, in their right mind, @ 'JCP' is going to go out of their way to prevent you taking up a new post if youv'e got one. (There's that much flack flying around over unemployment stats - especially with 06.05 looming!). - Besides, you'd be providing a heaven-sent opportunity for your local 'JCP' to "crunch" their monthly stats!
Re; staying on where you are - even for a short time - you'd be surprised how many caretaker opportunities exist in such situations. Employers, mainly, just muddle through in the interim - but if you don't ask 'em, they won't tell you, I'm afraid.

If you are talking about the 90-day consultation period, your perception is incorrect.
If 20 or more redundancies are envisaged, consultation must start at least 30 days before the proposed end date. Only if more than 100 redundancies are planned is the consultation period 90 days.
These are minimums so it is possible your employer has told employees that 90 days applies.
Then again, I'm confused about you saying that your contract terminates on 31 March. Are you saying that is the date of TUPE transfer to another employer - from whence you anticipate being made redundant shortly after?
If you have already been told you are redfundant it somewhat makes a mockery of any consultation process.
What you need before you can be sure of getting any redundancy amounts is the letter informing you that your job will end at day X. Until you've got that, you haven't been put on contractual notice of termination by redundancy - so if you leave before that, the company could treat you as having resigned.
Having got the letter, you should be able to leave early - but discuss it with the employer.
I haven't the faintest idea why dragongiraffe thinks this situation is anything to do with Job Centre Plus - it isn't until you've received your notice of impending termination.

Many thanks we have lost a contract this finishes 31/3/10. We have been Tupe over we had a meeting last week & told no positions for office staff & we would been made redundant
Then you need to wait for a formal letter from the new employer informing you of your impending redundancy before you can start negotiating to leave early. Otherwise they will almost certainly treat it as you having resigned (and avoid having to make a redundancy payment).
