Third party listening in to phone calls

Can anyone tell me whether a telephone conversation between two people that was being listened into on speakerphone on one side without the other persons knowledge would be admissable as evidence in court or would it be classed as hearsay or inadmissable? I know if you tape someone without their knowledge it is generally inadmissable in court- but what about listening in and using that information against the other person? Is it an invasion of privacy?
