where do i stand,with a will and a house?

hi people,ok shall make it short,i married last year,who owed his house ouright,as he bought it with his wife who,has now passed,however i gave up my private home up after 10 years,with my son who is 10.unknown to me my husband has made a will,leaving 40/40 to his two sons and 20 grand to me,as my husbands house has to be sold no matter what,i have no problem with this my only concern is if he passes away i will be left homeless,and he has made a will and both of his sons have signed his will that at present they inherit 40/40 of the house,and my husbands older son is in charge of the will,i have read the will and it states, im so confused where do i stand as a wife,so all i can make out is,i will be left 20 grand and some contents,this is making me feel alone im so insucure,please anybody,im so depressed ive gave everything up and also lost my daughter,i sold everything i owed for 30 years to have a life with my husband,i feel cheated as he says i could be worst off,i would rather have a new life on my own and feel like a goldigger,im his wife and he says i have no say about his will and want he wants :(((

she asks where she stands ... the will is most likely invalid so you should not worry! BUT life is too short to waste in this 'slavery'!

If he did this will before you got married it would be invalidated by the marriage anyway...unless it was done with the marriage incorporated into it... I know there's a proper term for this

Why not suggest doing new wills together with everything out in the open.. with a solicitor..
If the sons are to get 40% of the estate each, who gets the remaining 20%?

mark im sorry its not about money,its about where i stand homeless with a child under 18 years old,i cannot work due to illness so 20 grand would be rent money,however thank-you all ,i feel its A SHAMBLES lesson learned husband didnt want 2 live alone.
yes, could it be the separation of the tenancy? like you will be tenants in common by those percentages?

couldn't you all live there anyway?

btw are you saying 20 per cent or 20 grand?

anyway, if you feel trapped, why not contact a refuge and get out of there?

Sounds like divorce is a better route if you really feel he is just using you...

i still don't get how you'd be any worse off than before you married him? In fact you'd be 20k BETTER off. You were perfectly happy to live in rented accom before your marriage - so what's changed. TBH this man and his former wife spent years presumably paying off a house, that you now don't want their sons to benefit from, but want you and your son to benefit from!

I have already told you where you stand. You can make a claim under the Inheritance Act for reasonable financial provision after his death if his "Will" (and I actually doubt this is a Will) remains unchanged.

YOU feel used badly? How about him? - married for a year and you want his house.
PS this is all academic anyway - he might outlive you!

no i not even allowed to put a picture up or change a colour in a room,he can have it all fed up of him saying depending on how his sons treat him he will change his will,and thats bad im outta here deffo,he is 20 years older by the way.24/7 care from me.like i say i know how his sons feel but they glad im here thats all ,i want nothing.

Well from what you have said THERE IS NO VALID WILL if there were no witnesses and it was before your marriage and was not expressed to be in contemplation of marriage. So it might be worth sticking around a bit.
I think you just wanted someone to tell you what you already knew....
well if you want nothing, why are you blathering on about the will? Just leave.
Also, just cause someone is older than you doesn't mean they are going to die first.. In your position i'd be more worried who'd look after my 10 year old if i died
It strikes me that you want your cake and eat it, your husband bought his house with his first wife, so why not let their sons have the property, you had nothing to give to the marriage so why should you benefit at his death.
