Tupi over to new firm

My son has worked for a gardenning firm for the last 6 years and has been told that the company are to be taken over shortly on a tupi basis. He is not in a union so I dont really know his rights. Can he take redundancy if he does not want to transfer over to the new company - has any one else been through this procedure?

He can't take redundancy. If he refuses to work for the new employer - which he has the right to do - it will be regarded as a resignation from his employment. (Under such circumstances your son might not be entitled to receive Job Seekers Allowance because he'd be regarded as having voluntarily made himself unemployed).

The TUPE means that all terms and conditions of employment would remain the same, he would simply have new management. It may be worth giving it a chance rather than being out of a job. I was subject to TUPE 2 years ago, my job has improved significantly.
