if someone has been of sick for over 12 months on SSP, and the illness becomes so bad they have to give up work altogether can they claim holiday pay from there employer for the year they have been off ??

I think the answer is 'no' even in spite of the European Court ruling about claiming holiday pay when one has been sick. The issue here if if you leave the job having been sick for the whole year, you can't claim the holiday pay. Read the guidance on this weblink under 'Sickness' and also further down under 'When you leave your job' - the very last sentence.
Ring ACAS and double-check if you wish.
