Would Tina In Coronation Street Have Any Legal Claim To Keep The Baby In Real Life?

and would the hospital really give out information about the child first to someone other than the legal parent/guardian?
Yes a judge would usually rule in Tina's favor as the mother, unfair but that's life.
As Tina gave birth to the baby the hospital would call her first.
IT would be very unfair seeing that she accepted a large sum of money to be the surrogate. Much more than the amount considered ok for expenses.
In real cases when the surrogate has kept the baby the jud has ruled in her favor. Even though sh received a lot of surrogacy money!
Surrogacy is not legally enforceable , if the 'birth mum' decides to keep the child there is nothing to stop her as she is the legal mother . She could be sued for the return of the money paid to her though as she did not fulfill the contract.
Does it make any difference who is the biological mother? For instance, if the adoptive mother had donated her own eggs for the surrogate to carry.
(Don't watch Coronation Street, but just wondering)
Can she also come to the Father, can't remember his name, for support? That would be the ultimate unfairness for him.
Why did she have to spend a whole week in hospital I know the baby was premature but some mums are home in a few days!
Tina was anaemic or had some other problem which meant she had to stay in for few days
I reckon the baby is full term and Tina was already unknowingly pregnant with Tommy's baby prior to Gary's sperm mixed with Izzy's eggs being placed in her womb. The plot will need DNA to be taken that proves the baby cannot be Gary's and hey presto a happy ending for Tina and Tommy.
But if the baby was full term surely the experienced staff would know this?
Yes surely the hospital would know that the baby wasn't "small for dates", unless it's illness makes it appear smaller.
The doctors would not have performed the IVF if Tina was already pregnant.
It's a story for fluffs sake
Any similarity to real life is pure coincidence.
In 'real life' the origin of the eggs or sperm is not significant the ' Mum' is the one who carries the child to term in her womb , the Mum has full legal rights over her child and can keep it if she wants .
Surrogacy give no legal 'right' to the child. If the birth Mum does want to give the child up to the surrogate parents it has to be done by adoption after the birth.
Puts a huge question mark over DNA tests to prove parenthood, don't you think?
