Delayed Payment of Salary

In my workplace,we are all supposed to be payed monthly. We are paid by the BACS method,which-I am told-should mean that we all should get paid on the same date. But we are not...it seems to vary according to which bank we may be with. I have always been among the first as I usually get paid by the 6th.....while others may wait until the 10th-12th.....tho 10 days is supposed to be the max. This month.no-one has been paid as yet....and we have been told it will not be until the 14th. The reason given for such a delay is that the 2 weekends there have been in this month so far are not counted,and therefore the 10 working days that have passed is legitimate. Is this true? ....it is playing havoc with bills and direct debits for all of us, and it just seems a way that the company can hold on to our money and collect the interest. It is not good to be left with �3 in the bank!

I reckon this excuse is hogwash. You have a right to be told what method the company uses to calculate the pay date in the month. Many companies select the last day of the month. Some might select a specific date in the middle of the month - say the 10th. In both of these cases the money must be in your bank by the date identified.
I suspect that it is legal (if somewhat unusual) to devise a cunning formula along the lines of 'the 10 working day after the start of the month' (say). In such cases the date might shift according to the day of the week of the 1st. But go back to the company, demand to know what the policy is, and remind them (nicely) that they should ensure the money is deposited according to that policy.

I agree buildersmate....unfortunately-the way the company ( a residential care group) is run is shoddy and underhanded at best. Getting co-workers to complain en masse is impossible......we all need our jobs.

If you incur bank charges as the result of late payment of salary, go back to the employer and ask that they reimburse the charges. If they refuse, suggest that you propose to make a civil claim for damages in the small claims court. See what they say. The threat might work.

Thanks so much for that information buildersmate....I admit,I would not have thought of that. I will also inform my work collegues.
Where I work we are also paid usng the BACS system and there is a variation in the dates we get paid but only by 3 days tops. Our official pay date is the 25th of each month, some get theirs on the 22nd, some the 23rd so o and so forth but we have all been paid come the 25th - its something to do with what bank or BS we use
You cannot be expected to be paid on such varying days each month - I would suggest ACAS as well as the CAB
