Uninsured Driver??

I was involved in a car accident in June this year, the other driver has admitted full liability and police attended the scene. When I contacted my insurance company it materialised that I was not actually covered even though they had issued me a cover note to tax my vehicle on the day of the accident.

I decided because of this I would await the other drivers insurance company to sort it out and leave mine out of it.

It turns out that he may not be covered on his policy either and I have been advised that I may have to claim from him direct or use my own insurance company.

I am stuck with a vehicle that has been written off but no payment has been sent.

Also I have had a vehicle from drive assist from June 3rd this year and was under the impression that this was from his insurance company...Turns out that this was nothing to do with them and I am also concerned that they will try to charge me for nearly 4 months hire at �65 per day!!

Does anyone have any good advice for my next move?

why is it ,after the ins company issued you with a cover note,that they have said you were not insured,tell us this and we might be able to help,but please be honest.
Had you paid any money to your company, and why might he 'may' not be covered in this instance?
Why did you have a cover note and no cover?

and did the drive assist car appear out of nowhere? surely it had paperwork so you know whos providing it?
...involved in...materialised...no cover...may not be covered...mysterious hire cars...turns out... hmmm, I smell fish...

Ok..Where to start. I was on a corperate insurance through an old employer who still kept sending me cover notes upon my request. When this accident happened they advised that I wasn't on the policy. I hadn't paid for it but when they kep sending the cover notes I thought I was insured. (and very cheaply too!!)

The 3rd party insurance company are claiming that he is not insured for driving on business when he actually was/ they are writing to me to confirm exactly as they cant tell me over the phone due to data protection etc.

The Drive assist car was organised by the RAC as they originally towed my vehicle away and the other driver confirmed he was at fault.

the drive assist car will be billed to you and then its for you to claim for the cost of it through your insurers.

If you werent paying for insurance and it had been through an old employer then really you should have checked you were covered when you left the employment. Why would you need to keep requesting cover notes anyway?

It looks as if you shall have to fight this battle with the other drivers insurers alone. Id also give drive assist a call ASAP to try and sort out a payment plan or something. Find all the paperwork where you signed for it and see what it says.
yea sorry to say it doesnt look to good at the moment. always be careful of what you sign!
Why would you assume you were still covered by an old employer?! The cover notes were probably spewed out by a computer file that never had your name taken off it. Your mistake, that one I'm afraid, and one that his insurers can use against you when it comes to paying out... good luck with that.. your lucky you weren't in an accident through a fault of your own where somebody got hurt.
You'll need to put a claim into the MIB (Motor Insurers Bureau)
The at fault party's insurance company will pick up the bill, but because it's outside the scope of his policy, it'll be subject to an excess (�375 last time I checked) and it could take some time to be settled.
As far as the DriveAssist car goes, you have a very clear 'out' if, when you collected the hire car, they did not explain the terms of the hire to you. If what you say is correct, and you thought that the other party's insurance was paying, then it seems unlikely that this was explained to you. The Consumer Credit Act is there to protect you - point this out if they try to bill you.

...The plot thickens.....Drive assist are now telling me that I shouldn't of had the vehicle in the 1st place and actually haven't been insured for driving it since June!!!!

the moral of this story incident, (which has so many twists and turns) is , regarding the "hire car and drive assist" , is that over three months ago , you should have consulted a SOLICITOR" regarding the DRIVE ASSIST HIRE CAR, just to see if , you could be made liable at any point in the future ti have to pay for all or some of the DRIVE ASSIST CAR HIRE ,...... not forgetting that it is hinted that you may not have been covered insurance wise to drive the HIRE VEHICLE (ALARM BELLS !!!!) , and of course a SOLICITOR may have been able to advise you from the start of this , trilogy of an INSURANCE . dont always think , "that everything is taken care for, a motorist, even if you are fully comp.......... too many if buts and maybe on this "TRILOGY OF AN INSURANCE CLAIM" , coupled up ith the DRIVE ASSIST , hire vehicl scenario ......
