My sister has booked a weeks holiday to cyprus with me for my wedding in 5 weeks. She is bringing her daughter who is 18 months. The father who sees the child once in a blue moon has gone to a solicitors to stop my neice from going and its going to the courts. He has no access to the child and my sister has a restraining order from him being anywhere near her(my sister not the baby)What can she do. The solicitor says he has rights to stop her from taking my neice abroad for a weeks holiday. please help.

As long as she can prove to the courts its once in a blue moon and that she has a restraining order placed on him ,then i really cant see a judge stopping her taking her baby abroad .
I mean she can give the judge an address etc and they can verify this .surely!!!!

believe me the courts will NOT stop your niece taking the baby on holiday if the so called father does not have parental responsability in any case he couldnt anyway its a holiday and not a permament situation.have a good holiday.
Even if he had parental responsibility I very much doubt he will win a court case to stop his daughter going on holiday for a week.

The law is there to stop parents taking children out of the country for a significant amount of time.

Not only will he be wasting his money, he will be wasting valuable court time and this wil not be favourable to him..especially since a regular contact order isn't in place. If it is his solicitor who says he has this right, he is probably only saying it so that he can line his pockets.

does the father have parental responsibility??
It all depends on whether he has parental responsibility which he will have automatically got if he registered the birth with your sister
