I have purchased a dell laptop, which is very good by the way, I am paying by direct debit monthly, and I have not missed one of the payments.
Dell Have taken out two payments last month - one at the start of October and one at the end of october - this has caused me to go overdrawn on my current account - my bank is now charging me 40 in fees.
My Credit agreement outlines the payments are monthly - but dell cutomer services are claiming I have missed a payment in April - its a direct debit so surely the empahasis should be on them to take money out of my account?

Can i Take them to the small claims court and how do I do that?

first i'd go to the bank and ask for a statement back to april.i know the royal bank of scotland doesn't charge for this as my local branch never has.not sure about claims court but if it was me i'd go to the bank first.if the transaction is there in b/w they haven't a leg to stand on.
