other car was indicating !!

i recently pulled out of a local petrol station onto a main road to turn right. coming from the right hand side was a car that was indicating to turn left into the petrol station. at the last minute the car decided not to turn left, which then meant she drove into the side of me ! who is at fault ?

This is infuriating I know, but that's how it is. The argument goes that because somebody is indication to turn left, it does not mean that they are turning left where you are. They could be intending to turn left (or pull in) after thay have passed you.

I did post an answer - which timed out, but it's basically the same as JudgeJ has said.

In law, you are not empowerred to make an assumption of another driver's actions, and act accordingly in a way which makes them deviate or collide.

If it came to court, it's your word against your collidee that she was indicating at all - she just has to deny it, and you are at fault.

If you rinsurances are involved, ask your company's advice, and hopefully they will offer to settle, and that will mean you loose your no claims. If the police are involved, you could get prosecuted for driving withouy due care - and fined.

Sorry to be the bearer of bad news - I know hoe you feel - I had a similar incident once - got done for it. 

It's a cliche but the only thing an indicator is telling you is that their indicators are working.

So you are at fault, assuming that the oncoming driver was not driving at some reckless speed for which you've got independant witnesses.

I agree with the answers given.  The only thing that may help is if you've got a witness that also saw the car indicating then if you took it to court it's not just your word against theirs.  But I dont even know if this will help for sure.

It's really annoying and I'm sorry to hear of your situation.

I was once hit in the back and this was deemed my fault as I had pulled out of a side road into a main road.  I was about 100 yards up the raod and doing 30 when the guy hit me.  As I had no witnesses it was my fault even though the guy left huge skid marks indicating he was clearly speeding.

Unfortunately, when driving you have to learn to expect the unexpected.  You assumed that the other party knew what was going on so in reality the fault is yours no matter how hard that seems.
Another one of the joys of motoring.
I was pulling into a narrow street lined with cars so I was cautiously edging out.  I was hit by a speeding car driven by someone with no licence or insurance and there were witnesses who said he was driving too fast.  Guess what..... it was my fault!  He got some kind of community service and I got a written off car and increased insurance.
Assume makes an "ass" out of "u" and "me"! My driving instructor told me that yonks ago stuck with me ever since. Those above are correct, never assume that an indicator means anything until you see action.
you may be able to get CCTV footage of the accident from the garage.
all i know is that you would fail your driving test for presuming someone was going to turn left, you have to actually wait until they turn before you pull out, they may afterall have left the indicator on by mistake.
Assume every other driver is a d*ckhead and you won't go far wrong!  Common sense isn't good enough for the law.
