As the car was not yours when the offence was commited how can the police or dvla charge you?

You said it had been sold.

the buyer hadnt turned up for it so it was still in my name

Have you a receipt for the sale? if so even if the V5 is still in your name & the byer has paid you & you have a receipt, do not worry it's not your concern.

i dont no what neighbour it was i have by suspitions but thats all and the car was sold on ebay so dont know where i stand as it was still in my name
If the car was still in your name you are responsible for it,and as I understand it, a car that has been "SORNed" should not be on a public highway.
A car that has benn declared as SORN,must be kept off the public highway,in either a driveway or garage,or other off street place.
You said that you had sorned it, so I take it that there was no Tax or MOT before the sale on eBay! I that's the case you will get done, you may also get done for no Insurance that is, if you had cancelled it.

This details maximum penalties for declaring a false SORN

However, this link says if you a buy a vehicle that is SORN, the SORN comes to an end the day you buy the vehicle. You should have a record of this date and the sale in your My eBay section.

Not sure when you declared it SORN, so it's unclear whether you declared a false SORN or your ownership had in fact ended.

I like the user name :-)

The Registered Keeper remains the Registered Keeper until DVLA update their database with details of any change. The Registered Keeper is the person responsible and liable for all vehicle documentation offences (MOT, Tax, etc.) regardless of who the Owner may be.
