can my neighbours gates open onto my land or should they open onto theirs

I'm not an expert on the law, but surely, if it opens onto your land, when they open or close it, if they have to come onto your land to do it, they are trespassing.


I don't know if there is a legal precedent, but as far as I know when I have erected fences during the construction of new roads, the gates should open into the property they belong to, unless there is some good reason they can't (eg a steep ramp or something).

Thanks very much. is a bit of a tricky one because they have vehicle access over our land. the gates do open onto our land though. should the gates open onto there own land

you need to be more specific with the type of gates, are they electric gates? pedestrian gates? what are they used for? but generally gates should open onto the property of the owner unless he got consent from the previous tennant, are they emergency exit gates? in which case they have to open in the direction of the exit route. But if i were you every time he opened his gates send your dogs round to crap on his lawn.

when i put gates up they open onto the owners land, unless, as stated before a ramp stops it!! but we recently had trouble with a steep driveway and had to hang the gates opening out with instuctions from the customer!! but within days the council made him reverse them??

the gates are for vehicle acces to their garage and are wooden double gates.One gate opens into their garden and the other into mine. The only reason it open outwards is because one side of the gate would block entrance to their garage. they did not ask our permission. this only one problem of many with my neighbours.they have private motor vehicle access only over my land.

in that case his gates should open onto his property, we fit sliding gates and 'barrier' gates to overcome the garage door problem, but they are costly so hes obviously cutting corners, also if a gate opens onto your property then there MUST be an audible and visual warning that the gates are going to open, hope this helps?

As i said wouldnt be long before this caused trouble. Asked them really nicely today if they could change their gates around and was very non polietly told to prove it (that they should open onto their land not mine).


Any one with any concrete evidence that they must open inwards - i would be more than grateful
