We have just sale agreed our property. However we have just received the house sellers questionairre to fill in. Unfortunately we have spent many years in conflict with neighbours regards to large conifers on our plot. Last year these were removed as our neighbour reported slight cracks on his conservatory brickwork. His insurance company requested that the trees were removed which we allowed. The subsidence was classed as 2 very slight and cyclical in nature prob due to hot summer 2003. Do we need to mention this or should we just say that the insurance company did not like the idea of trees being so close to proximity.

If you're filling out a SPIF (Sellers Property Information Form), then you have to give full disclosures. Incorrect information could entitle the buyers to compensation or to refuse to complete. If the subsidence only affects your neighbour then it's not strictly relevant.

You still need to "declare" any conflicts with neighbours regardless of situation. We had similar situation. Solicitor added "explanation" on separate sheet, just adding what was relevant.
