In July of last year on the way home from a family gathering in a pub/restaurant a friend of my nephew came behind us shouting insults at him, when he got closer my partner and his cousin tried to calm the boy down, to which we thought had worked. As we walked away the boy came behind and struck the cousin who fell to the floor, as my partner turned he also was struck causing him to fall on top of his cousin. The boy then ran. He returned 5 mins later with family who were under the impression he was the one who had been hit, as the family members who were also known to us all as neighbours in same street seen the injuries caused they automaticaly agreed we were the ones harmed and not the boy who was claiming self defence. My partner who is father to out 2 children is 6 ft and 16 stone had his lip tore off needing 7 stiches and has left alot of scaring, his cousin who is also same size, wore glasses whick broke and caused servere damage to eye and face, the police believe the boy carried a knuckle duster but as none of us seen this as it was so fast it cannot be proved. Also while we were waiting for the ambulance the boy who was still as we think high and very drunk, struck the cousins girlfriend in the eye causing only bruising, and hit my partner again breaking his nose which he has since had surgery. This sounds as if we just stood round letting this happen but i had to hold both men back to stop them attacking the boy as he was only 17 at the time and i was affraid they would end up on the wrong side of the law.
Any the reason for this long story (sorry) is we are now waiting for crown court the boy is still claiing self defence and not guilty even though he never got touched from anyone. He has been charged with 2 x GBH without intent and 1x commen assault. Can anyone give any advice or idea on how this could go in court we are so worried he will get off for this.

Hi

Are you aware whether the offenders family have made formal statements to the police and were there any independent witnesses?.
Question Author
no his family have not made any statements as they were not there at first incident then when they were asked about second attack all of them said they seen nothing which suprised us, there was only myself, my partner, his cousin and girlfriend gave statements. The boy also admitted in interview that he did not get hit before he stuck out and noone stuck him at any point, yet still insists it was self defence?
Ok

Well at least the family can not go back and defend the offender (with any credit).

Self defence is probably the last line of defence available to him after what he said in police interviews. It is a matter of law and for the court to decide whether he acted in self-defence etc.
Also the injuries to the victims suggest the offender has gone beyond self-defence.
